According to data from the Lyst platform, consumers are increasingly interested in items from the Paris-based brand. The increase in searches for Marine Serre is 22% since March. She showed <strong>her first complete collection in Paris in February 2018<\/strong> (after winning the <a href=\"https:\/\/highxtar.com\/lvmh-prize-2020-will-distribute-the-prize-among-the-finalists\/?lang=en\"><strong>LVMH Young Fashion Designers Award<\/strong><\/a> the year before) &#8211; he has, however, found a niche within the sphere of haute couture.<\/p>\n<p>Now from New York to Paris, the brand&#8217;s leggings and tops with moon prints can be instantly identified. That&#8217;s why Marine Serre has been looking to secure its brand registrations worldwide. A month later, a<strong> provisional refusal was issued<\/strong>, stating that the repetitive lunar pattern does not actually act as a trademark and is instead decorative in nature.<\/p>\n<p>Marine Serre argued that <strong>&#8220;the mere fact that a mark fulfils a decorative function does not affect the assessment of its distinctiveness&#8221;<\/strong> and thus its ability to serve as a mark.<\/p>\n<p><img decoding=\"async\" class=\"aligncenter size-full wp-image-129210\" src=\"https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-4.png\" alt=\"Marine Serre\" width=\"1024\" height=\"663\" srcset=\"https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-4.png 1024w, https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-4-300x194.png 300w, https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-4-768x497.png 768w, https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-4-973x630.png 973w, https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-4-508x329.png 508w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/p>\n<p>On<strong> February 11, 2020<\/strong>, the EUIPO stated that <strong>&#8220;after careful consideration of Marine Serre&#8217;s arguments, it has decided to maintain its objection and refuse to register the mark, largely because the moon design is &#8220;devoid of any distinctive character&#8221;<\/strong>.<\/p>\n<p>The design of the multiple moon <strong>&#8216;does not present any element that is easily and immediately identifiable by the relevant and attentive public, and will therefore be perceived exclusively as a decorative element&#8217;<\/strong>.<\/p>\n<p>Serre had two months to appeal the EUIPO&#8217;s decision but apparently chose not to do so. However, the EUIPO continues to list the application as &#8220;under examination.<\/p>\n<p><img decoding=\"async\" class=\"aligncenter size-full wp-image-129214\" src=\"https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-5.jpg\" alt=\"Marine Serre\" width=\"994\" height=\"702\" srcset=\"https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-5.jpg 994w, https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-5-300x212.jpg 300w, https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-5-768x542.jpg 768w, https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-5-973x687.jpg 973w, https:\/\/highxtar.com\/wp-content\/uploads\/2020\/05\/highxtar-marine-serre-no-derechos-media-luna-5-508x359.jpg 508w\" sizes=\"(max-width: 994px) 100vw, 994px\" \/><\/p>\n<p>If it succeeds, <strong>Marine Serre would be the first brand to co-opt an item allegedly dating back to 2300 BC<\/strong> and use it as an indicator of its brand.<\/p>\n<p>And, if <a href=\"https:\/\/highxtar.com\/gucci-announces-its-collaboration-in-the-game-tennis-clash\/?lang=en\"><strong>Gucci<\/strong><\/a> was able to acquire the rights to the green-red-green stripes, we don&#8217;t see Marine Serre&#8217;s moon as impossible. It is true that it took decades &#8211; not four years &#8211; and tens of millions of dollars in advertising and marketing for the brand to claim that when consumers see it, they can quickly link symbols or colors to the signature.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Marine Serre has been looking to secure its brand registrations around the world.
