Just over a year after settling Nike’s lawsuit against the brand, MSCHF has been hit with a new lawsuit over its new “Wavy Baby” by Tyga trainers, this time from Vans.
According to a 57-page filing in the Eastern District Court of New York on Thursday, Vans and its parent company VF Corp. allege that “MSCHF engaged in a campaign to profit from Vans’ rights and the goodwill it has developed in its iconic trainers” by offering proprietary footwear that “blatantly and unambiguously incorporates Vans’ trademarks and trade dress”.
In the new lawsuit, Vans argues that, with the Wavy Baby trainer in collaboration with rapper Tyga, MSCHF is infringing the trademark and trade dress rights of the 40-year-old OLD SKOOL trainer. The deformed sole, however, has not been seen before. MSCHF said Vans wanted to settle: “It turns out they were shaking our hand while stabbing us in the back”.

En 50 años de lanzamientos de zapatillas, nunca ninguno de sus zapatos había recibido tanta atención antes del lanzamiento. The Wavy Baby es transformador por encima y más allá de cualquier intento de Vans”.
